DIGITAL CONTENT WAIVER
I, (name) (“Talent”), residing at (address), enter into this Agreement with Mass Premier Courts, LLC (DBA X Factor Hoops Training), a Massachusetts Limited Liability Company with its principal office at 97 Green St, Foxboro, Massachusetts (“Production Company”).
I hereby authorize Production Company to photograph and record (on film, digital, video, tape, or otherwise), my image, voice and/or performance; to edit the same at its discretion and to include it with the performance of others and with sound effects, special effects and music; to incorporate same into audio and/or video productions at the sole discretion of the Production Company; to use and to license others to use such recordings and photographs in any manner or media whatsoever, including without limitation unrestricted use for purposes of publicity, advertising and sales promotion; and to use my name, likeness, voice, biographic or other information concerning me in for any other purpose.
I further acknowledge that the Production Company owns all rights to the results and proceeds of my services rendered in connection therewith. I understand that my image may be edited, copied, exhibited, published or distributed, including but limited to electronic display via the internet and waive the right to inspect or approve the finished product wherein my likeness appears.
Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording. I also understand that there is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed.
This release applies to photographic, audio or video recordings collected as part of the sessions listed as follows:

July 27, 2022 and subsequent dates
Mass Premier Courts, Foxboro, MA (the “Production”)
I confirm that I have the right to enter into this Agreement, that I am not restricted by any commitment to other parties, and that the Production Company has no financial commitment or obligations to me as a result of this Agreement. I hereby give all clearances, copyright and otherwise, for use of my name likeness, image, voice, appearance and performance embodied in the Production. I expressly release and indemnify Production Company and its officers, employees, agents and designees from any and all claims known and unknown arising out of or in any way connected with the above granted uses and representations.
This Agreement shall be governed by the laws of the Commonwealth of Massachusetts. Any dispute arising out of or relating to this Agreement, exclusively shall be brought in the state courts located in Suffolk County, Massachusetts. Each party hereby waives any objection to the personal or subject matter jurisdiction and venue of such courts.
In the event that any one or more of the provisions contained in this Agreement shall for any reason be held invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provision of this Agreement.
By signing this form I acknowledge that I have completely read and fully understand the above release and agree to be bound thereby.
